SUMMARY OF ACT 1

Act 1 of 2006, also known as the Taxpayer Relief Act, was signed into law in June 2006.  It was designed to reduce property taxes through a combination of state and local revenues.  The state portion will come from revenues received from slot machine proceeds.  The local portion will come from higher earned income taxes if a majority of voters pass a front-end referendum that is required to be on the May 15, 2007 primary ballot.

The key components of Act 1 are:

  • requires the establishment of a Local Tax Study Commission (LTSC) to recommend tax change
  • requires a front-end voter referendum on a tax switch from property to income taxes for a portion of property taxes
  • limits future property tax increases by requiring back-end voter referendum on property tax increases above an index established by the state
  • establishes a new budget timeline and process
  • mandates that district offer installment payments of property taxes
  • makes modifications to the Property Tax and Rent Rebate Program
